ACORE Capital, LLC (“ACORE Capital” or “we” or “us”) respects the privacy of visitors to this Site. This Privacy Policy describes how and when we collect and use the information collected from visitors to our Site. Capitalized terms not defined in this Privacy Policy have the meanings set forth in the Terms of Use available at http://www.acorecapital.com/dev/PrivacyPolicy. If you do not agree with the terms of this Privacy Policy, do not access the Site or otherwise use the services.

Information We May Collect

Personally Identifiable Information. If you voluntarily submit information to our Site, for example, in a request for general information to one of the email contacts provided or through the submission of a business proposal, we may record and use any personally identifiable information, such as your name, phone number and e-mail address, for reasonable business purposes including, but not limited to, fulfilling your request.

Technical Information. As is true of most websites, we may record certain non-identifiable information that becomes available to us as a result of your visit to our Site, including, without limitation, the number and frequency of visitors to our Site. This information includes, for example, the Internet browser you are using, the time and date of visit, your operating system, and your IP address. If we use such data at all, it will be on an aggregate basis, and we will not disclose to third parties any information that could be used to identify you personally except to our service providers on a confidential basis as described in the “Information Sharing” section below.

Cookies. We may use cookies or other similar technologies to collect certain aggregate and non-personal information when you visit the Site. Cookies are small files that are placed on your computer’s hard drive when you visit certain web sites. Cookies help us understand and improve the use of our Site and its functionality. Most web browsers allow you to disable cookies, however if you do so, some features of our Site may not be available to you.

Do Not Track Requests. ACORE Capital does not track Site users across third party websites and thus does not respond to Do Not Track (“DNT”) signals. However, some third party websites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, certain website browsers allow you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.

Children. This Site is not provided for individuals under the age of 13, and we do not knowingly collect personal information from children under the age of 13. In the event that we learn that we have collected personally identifiable information from a user of the Site that is under age 13 without verification of parental consent, we will delete that information where reasonably possible.

Information Sharing

We may use internal and external service providers to assist us in the operation of our Site and employ other service providers to perform work on our behalf. These third party service providers may have access, on a confidential basis, to the personally identifiable information you submit through the Site, but only for the purpose of performing their duties related to the Site. These persons are contractually obligated to not use your personally identifiable information for any other purpose.

We may also share information with our affiliates, including for marketing purposes, but we will not sell or share your information with unaffiliated third parties for their own marketing purposes.

We may also share information to fulfill our legal obligations in response to a request from the government or private parties in connection with a lawsuit, subpoena, investigation or similar proceeding, or to respond to a matter of personal or public safety, to investigate security incidents, to protect our interests, rights and property.

We may share information with a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of ACORE Capital’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which information held by ACORE Capital about our Site users is among the assets transferred.

Your California Privacy Rights

California residents may request and obtain once a year, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. California residents may also choose to opt out of such disclosures, if any. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. California residents may make such a request in writing by emailing legal@acorecapital.com with your name and address, and noting “California Shine the Light Request” in the subject line of the email.

ACORE Capital uses reasonable technical, physical and administrative safeguards to protect the personal information entrusted to it. However, we cannot guarantee the security of our Site, and all transmissions online entail risk. Do not send any sensitive information to us through our Site or through any other unsecured channel.

This Privacy Policy is effective as of the “Last Modified” date stated at the top of this Privacy Policy. It may be necessary from time to time for us to modify this Privacy Policy to reflect changes in the way we collect and use information or changes in privacy-related laws, regulations, and industry standards. Accordingly, we reserve the right to change this policy at any time by posting the revised policy on this Site and updating the “last modified” date at the top of this page. If the changes are material, we will provide you additional, prominent notice as appropriate under the circumstances.
